The tax on losing, and what else nobody tells you
Kenya's own Parliamentary Budget Office pointed out that a player who deposits and withdraws without placing a single bet can still be taxed on the way out. That is a policy fact, not a rant. This site starts there and works through what is actually charged, what is genuinely unsettled, and what the alternatives cost you.
Three separate charges get mixed together in almost every Kenyan betting article. A 5% excise duty on money deposited for gambling. A 5% withholding tax when money is paid or disbursed to a player's account. And a 20% withholding tax on winnings, which the Finance Act 2026 reintroduced but defined narrowly as a payout from a lottery or prize competition by a person licensed under the Gambling Control Act 2025. Different statutes, different trigger points, and only one of them is genuinely contested.
Getting this wrong is the norm, not the exception. One popular Kenyan guide calls the 5% on withdrawals an excise duty. It is a withholding tax. Another still publishes 12.5% on stakes, which was never the 2026 position. A third still cites BCLB and Cap 131, both superseded in August 2025. We name those errors on the pages where they matter.
The tax on losing
“If a player has deposited funds but decides to withdraw them without placing any bets, they could still face a five per cent tax on that withdrawal, despite not earning any income.”
That is Kenya's own budget office, not a punter on X. A lawyer put the redistribution just as plainly: under the old regime the winners paid the most, and now every bettor pays on the way in and on the way out whether they win or lose. When the rule landed in July 2025, people started calling it a tax on losing. The name stuck because it describes the mechanism accurately.

The middle row changed in a way almost nobody reported. The Finance Act 2026 redefined withdrawals from money taken out of a betting wallet to money, cash equivalent or money's worth paid or disbursed to the player's account. That moves the tax point earlier and closes the trick of deferring it by re-betting from your winnings instead of withdrawing.
Where the offshore crypto route actually differs
Reg. 86 of the GRA Conduct of Gambling Operations Regulations 2026 prohibits licensees from using virtual assets for gambling or withdrawal unless the Authority approves it. Two things follow. Crypto gambling in Kenya is structurally offshore, so you are not choosing between Betika and a crypto book on the same regulatory footing. And that regulation binds licensees, not players, so nobody should tell you crypto gambling is illegal for you on the strength of it.

Read the last two rows before the first three. Losing GRA recourse is a real cost, and a 14-day statutory payment penalty is a real protection you give up. Anyone selling you the offshore route without saying that is selling.

Is Kenya restricted
No. Whale.io's restricted-jurisdictions page, last updated 14 November 2025, names 13 countries and Kenya is not one of them. There is also a blanket clause covering FATF blacklisted countries. Kenya sits on the FATF grey list, which is a different list, so that clause does not catch it either. Grey-list status is reviewed again at the October 2026 plenary, so this is worth re-checking rather than assuming.

Is the 20% withholding tax charged on my casino winnings
Genuinely unsettled. The Finance Act 2026 defines winnings as a payout from a lottery or prize competition by a Gambling Control Act 2025 licensee. On that wording it does not reach a sportsbook or casino payout. Several affiliate sites assert otherwise. We found no KRA guidance resolving it and we will not invent one.
Why was 5% taken off my withdrawal
That is the withholding tax on disbursements, not an excise duty. The two get confused constantly because both are 5 percent. The excise is charged on your deposit.
Does an offshore casino deduct Kenyan tax
It has no Kenyan licence to withhold under, so it does not withhold. That is a statement about the operator's obligations and not about yours. What you must declare to KRA is a question for a tax adviser, and the position is unresolved.
